Terms and Conditions
"Buyer agrees to pay rental on each cylinder or container at the prevailing rental rates and will be responsible for returning all empty cylinders promptly. Buyer agrees to pay rental monthly. If rental is not paid monthly, Welsco reserves the right to pick up the cylinder without regard to contents. Buyer agrees to return all cylinders on demand of Seller or when empty and to pay retail price for cylinder if lost or damaged while in his/her possession. All costs of litigation and repossession, including reasonable attorney's fees, shall be paid by the Buyer. This agreement shall be governed by and construed under the laws of the State of Arkansas. Buyer agrees that in the event of default or litigation resulting from loss or damage to cylinder that he/she will consent to be subject to the jurisdiction of the Courts of the State of Arkansas to enforce the terms of this agreement and agrees that venue will lie in Pulaski County, Arkansas."
EXCLUSION OF WARRANTIES/ NO WARRANTIES DISCLAIMER:
Buyer acknowledges that seller is not the manufacturer of the products or goods sold. The implied warranties of merchantability and fitness for a particular purpose and all other warranties, expressed and implied, are excluded from this transaction and shall not apply to the goods sold. IN NO EVENT SHALL SELLER BE LIABLE TO BUYER FOR INDIRECT, SPECIAL OR CONSEQUENTIAL DAMAGES OR FOR LOSS OF ANTICIPATED PROFITS ON ANY CLAIM OF ANY KIND RESULTING FROM ANY ORDER HEREUNDER.
A LATE CHARGE MAY BE ASSESSED ON PAST DUE INVOICES AT MAXIMUM RATE ALLOWED BY LAW. THE TITLE TO THIS MERCHANDISE REMAINS IN THE HANDS OF THE SELLER UNTIL THIS INVOICE IS PAID.
TERMS: NET DUE 15 DAYS FROM DATE OF INVOICE
